END-USER LICENSE AGREEMENT FOR PINQUE, Inc. TRADING AS COTTAGE COLLECTIONS.
The designs and graphics in the Cottage Collections Graphic Collection are original designs, and hold a registered copyright. All rights are reserved.
The images included in this product/CD are licensed, not sold. Pinque, Inc grants you, the user a non - exclusive license to use the images in this collection only as authorized in this license agreement.
Pinque, Inc -End User License Agreement is a legal agreement between you and Pinque, Inc. By installing, copying, or otherwise using this graphic collection, you agree to be bound by the terms of this agreement.
If you do not agree to the terms of this End Users License Agreement, Do not install or use the graphics in this collection.
Ownership: The graphic collection on this CD is licensed, not sold, to you as the end user. Pinque, Inc retains full ownership of the product, images and any derivatives. These images are proprietary products of Pinque, Inc. and protected under U.S. copyright law. This entire collection has been registered with the US Copyright office.
This License Agreement gives you limited right of use in accordance with the terms of this License Agreement.
You may not lease, sublicense, or share your rights under this License Agreement.
Usage: All rights not expressly granted within this agreement are reserved by Pinque, Inc.
Pinque, Inc. grants to you, the licensee only, a non-exclusive right to use, modify, and include the images for personal web design, personal auction template design, e-mail stationery and printed documents. These items outlined can be used for noncommercial and commercial purposes without payment of any additional license fees.
You may not sell any of the accompanying images, or any derivatives thereof, either individually or collectively. You may not use or include the images, or any derivatives thereof, for any of the following without first obtaining consent of Pinque, Inc and the payment of an additional Business license fee.
You will not include images, or any derivatives thereof, in any electronic files to be distributed to any third party or used on other computers including but not limited to web pages, new and or graphic groups. You may not use, include, or distribute any of the images on a web page distributing images for others to download either freely or for a fee. These images may not be used in any graphics or clipart collection.
You are granted permission to use all graphics/images/files for your own personal web site and your own commercial web sites, but not for web pages, web sites, auction templates, logos, business card design, sign design, link exchange banners, web templates that you create for others either for a fee or free of charge. A Business License must first be obtained/purchased from Pinque, Inc.
When using these copyrighted images on a web page, website or auction template a text link "Graphics Designed By Cottage Collections" with a link to http://www.cottagecollections.com must be displayed.

Termination: This license is effective until terminated by either party. You may terminate
it at any time by destroying the CD/DVD and all images in this collection. Pinque, Inc reserves the right to terminate license upon failure to comply with any term or condition of this Agreement.
Limited Warranty: Pinque, Inc. warrants the CD/DVD on which the graphics/Images are furnished to be free from defects in materials and workmanship under normal use for a period of 30 days from the date of purchase. The licensee will assume responsibility for the installation, use, and results obtained from use of this collection.
Pinque, Inc is not responsible for providing individual instruction on the use of graphics in this collection or graphic software packages used to edit or modify the graphics and html templates in this collection.
If the Graphic CD is found defective within the Warranty Period, Pinque, Inc. agrees to replace it free of charge upon return of original purchase, postage paid. This warranty will not be applicable and be void if the defect has been caused by abuse, mistreatment or neglect.
Pinque Inc does not warrant that the images/graphics contained in the collection
will meet your needs or that the operation of the software will be free of error. See Limited warranty.
Limitation of Liability: Pinque, Inc. Trading as Cottage Collection's only obligation or liability under this agreement is the replacement of defective CD/DVD/Graphic Collection according to the limited warranty above. In no event will Pinque Inc be liable for any damages, or consequential damages arising out of the use or inability to use such program, or for any claim by any other party.
Jurisdiction: This Agreement and the Limited Warranty shall be Governed by the laws of Virginia. All disputes that may arise will be resolved in the state or federal courts of Virginia. The parties consent to the jurisdiction of such courts.
